Court Blocks Trump’s Passport Truth Policy Again

Once again, a federal court has chosen feelings over facts and fantasy over truth. On September 4, a panel of three judges from a federal appeals court upheld a lower court’s decision to block President Trump’s common-sense policy that requires passports to reflect biological sex—male or female—nothing more, nothing less. The policy was part of President Trump’s executive order to restore honesty and clarity to federal documents by ending the absurd practice of allowing “X” as a gender marker on passports.

Let’s be clear here: a passport is not a diary. It’s not a place to express your identity crises or social theories. It’s a legal document used for international travel and identification. It must reflect objective, biological truth—something that doesn’t change because a person “feels” different one day.

But the court didn’t seem to care about that. Instead, the judges parroted the emotional claims of activists, saying that blocking the policy is necessary because some people might face “harassment or violence” if their passports don’t reflect their chosen gender identity. That may sound sympathetic, but it’s also the same as saying we should rewrite reality to avoid offending people.

Let’s not lose sight of the facts. President Trump’s executive order, signed in January 2025, was aimed at ending the woke nonsense that took root under Biden. His administration had allowed anyone to check any box on a passport—“M,” “F,” or “X”—based purely on self-declared identity. No medical proof. No biological basis. Just whatever label someone wanted that day. That’s not government policy; that’s a kindergarten playtime rule.

President Trump stood up for truth. His order made it clear: the United States recognizes two sexes—male and female—and passports must reflect that. This isn’t radical. This is common sense. It’s science. It’s how civilization has worked for thousands of years.

But the ACLU, always eager to blur lines and undermine order, sued on behalf of a handful of plaintiffs. And in April, Judge Julia Kobick, an Obama-era appointee, blocked the Trump administration from enforcing the policy. Then in June, she expanded her ruling to apply nationwide. Now the appeals court has backed her up, not based on law or Constitution, but on the vague idea of avoiding hurt feelings.

The court even accused the Trump administration of having “unconstitutional animus” toward transgender individuals—because apparently, insisting on biological truth is now considered hateful.

Let’s be blunt. This isn’t about passports. This is about the left’s ongoing war against reality. They want to erase the differences between men and women. They want to force the government—and all of us—to go along with their ever-changing gender theories, even if it means putting nonsense on official documents. They want to turn basic facts into political statements.

President Trump, on the other hand, is fighting to bring sanity back. He’s standing up for women, for children, for truth, and for the rule of law. And let’s not forget, he’s doing it while the media, the courts, and the activist class try to tear him down at every turn.

This ruling is a setback, yes. But it’s not the end of the road. The Trump administration is likely to appeal this case all the way to the Supreme Court if needed. And it should. Because if we can’t even agree on what a man and a woman are, how can we expect to agree on anything else?

America needs truth, not confusion. We need courage, not cowardice. And above all, we need leaders like President Trump who are willing to say what is right—even when it’s not popular.
