Biden to Supreme Court: Cops Can Seize Guns without a Warrant

It seems President Joe Biden does not believe the adage that a “person’s home is his castle” because his anti-Constitution administration wants law enforcement to burst into homes and take guns.

“The Fourth Amendment protects our right to be secure in our property, which means the right to be free from fear that the police will enter your house without warning or authorization,” Institute for Justice Attorney Joshua Windham stated to the U.S. Supreme Court. “A rule that allows police to burst into your home without a warrant whenever they feel they are acting as ‘community caretakers’ is a threat to everyone’s security.”

Democrats repeatedly tried to invent creative ways to trample the Second Amendment. Liberals pushed so-called “Red Flag” laws that allowed them to decide the mental fitness of gun owners and invade the homes of mostly conservative Americans. The latest scam is to give law enforcement the power to break down doors without a warrant under the disguise someone might be contemplating suicide.

In a U.S. Supreme Court case called Caniglia v. Strom, police reportedly misled a woman that her husband consented to have his firearms seized after a marital squabble. According to reports, a Cranston, Rhode Island, couple got into a heated argument after the husband made a wise-crack about her brother’s alleged dishonesty. He said something to the effect that he wouldn’t drink out of the same coffee mug.

During the spat, the man retrieved an unloaded firearm and, jokingly, said: “Why don’t you just shoot me and get me out of my misery?” She left and later contacted local police about performing a wellness check because he wouldn’t answer her calls — go figure. Police officers reportedly called the man who they agreed “seemed fine” and had no criminal record. The 68-year-old man wanted to get checked at the local hospital after not feeling well due to stress and anxiety. Officers promised the man they would not take his firearms over the crack and marital incident.

At no point did officers claim an imminent danger or risk of bodily harm existed and did not contact a local judge to gain a warrant before the man returned home. Once he left for the hospital, they scammed the wife into leading them to his guns and took them without a warrant, permission, and based on a series of lies. The Biden Administration wants to expand this warrantless search and seizure to apply anytime a claim — true or false — is made under police “caretaking” policies.

It’s easy to see that the Democrat stumbled across a potential loophole to seize firearms without asking a judge. Under liberal U.S. Attorney General Merrick Garland, the U.S. Department of Justice takes the position that legitimate dangers and even facts no longer matter. If someone owns a gun, Democrat-controlled police departments such as the one in the notoriously Blue State of Rhode Island only have to pretend that gun-seizures are reasonable. Making the entire case stink of an anti-Second Amendment power grab, nine Democrat-run states joined A.G. Garland and the now-partisan DOJ.
