The Supreme Court threw even more cold water on crazed Jack Smith’s attempts to prevent Americans from voting for Donald Trump this week. The court granted certiorari to Trump’s argument that former presidents are immune from prosecution for their official acts while in office. The court even expedited the case, setting oral arguments for the week of April 22nd. This is terrible news for Jack Smith, since he had hoped to have Trump sitting in a courtroom on Monday.
Trump’s argument is a simple one. Every other president in American history has enjoyed presidential immunity after he left office. We have never prosecuted a former president for decisions they made or actions they took as part of their official duties. Donald Trump said some words on January 6th. We all thought that was protected speech under the First Amendment, but as usual, none of our laws or rights apply when you’re talking about Donald Trump.
Smith is trying to prosecute Trump for saying words about the electoral count. George W. Bush lied to get America into a war with Iraq. He then set up torture chambers in Afghanistan and at CIA black sites around the globe, and had suspects tortured in those sites. Barack Obama killed two Americans in a drone strike in Yemen.
If Obama enjoys presidential immunity from prosecution for murdering two Americans without due process, and Bush enjoys immunity from prosecution for torturing suspects and lying our way into a war, why doesn’t Donald Trump have immunity from prosecution for saying words?
It’s a simple question. The Supreme Court phrased it this way in the one-page notice granting certiorari:
“Petition is granted limited to the following question: Whether and if so to what extent does a former President enjoy presidential immunity from criminal prosecution for conduct alleged to involve official acts during his tenure in office.”
When the Supreme Court grants certiorari in a case, as it did here, all lower court decisions related to this case are supposed to immediately be put on hold. Once the Supreme Court issues its decision, all the lower courts are then supposed to guide their rulings based on what the high court says. They’re the bosses of the judicial system. Once they grant certiorari, you do not pass Go, you do not collect $200, and you do not kick President Trump off the ballot for a fake “insurrection.”
So, guess what happened immediately after the Supreme Court granted Trump certiorari?
A radical leftwing Democrat judge in Illinois kicked President Trump off the ballot in her state, after she alone decided that Trump had done an insurrection. Last year, the Illinois board of elections had ruled that Trump could not be kicked off the ballot—whether he had insurrected anything or not. Individual states just don’t have that authority.
But on Wednesday, after the Supreme Court granted Trump certiorari, Cook County Circuit Judge Tracie Porter kicked President Trump off the ballot.
The arrogance of Democrats in the judicial system is astonishing to behold sometimes. Porter is only a circuit court judge, and she basically just told the Supreme Court justices that they could stick their certiorari up their butts. We really need a better system for kicking judges like Porter off the bench and disbarring them so they can never practice law again. Maybe that’s something that we can accomplish during Trump’s second term. How is this partisan hag even a judge?
Trump’s attorneys say that if the Supreme Court opens their client up for prosecution for official acts, then it opens all former presidents up for prosecution. All future presidents would be hamstrung by indecision, because they’ll always be worried that they can be prosecuted for partisan retaliation.
President Trump himself raises a good point about this.
“Presidents will always be concerned, and even paralyzed, by the prospect of wrongful prosecution and retaliation after they leave office,” he stated. “This could actually lead to the extortion and blackmail of a President.”
That’s exactly right. The corrupt Department of Justice could simply tell a president to take this action or not take that action, otherwise they’ll throw the book at them after they leave office. All future presidents will subject to the whims of the Deep State.
